Any order taken under a product appearing in the online store of the site www.popeline-et-linon.com ("The seller site") assumes the consultation and prior acceptance of these general conditions of sale. The click of validation of the order implies a full acceptance of the present. This click has the value of a "digital signature".
The products offered for sale by Popeline & Linon are those listed on the site. The products are offered for sale within the limits of available stocks. The company Popeline & Linon takes great care in the description and presentation of fabrics and haberdashery. The products offered for sale are described with the greatest possible accuracy. If however the non-conformity of the product delivered compared to its description on the Site, the Customer will be able either, to exert its right of retractation, or to implement the guarantee of conformity of the Company POPELINE & LINON which will proceed, if necessary, either with the exchange or the refunding of the price. The photographs, texts, graphics as well as all the information and characteristics illustrating and/or accompanying the Products are not contractual, which the Client acknowledges.
3 - PRICES
The prices of the Products are indicated in Euros, inclusive of all taxes (including VAT) and exclusive of delivery charges, which shall be borne by the client. The prices take into account the possible reductions applicable on the day of the order. The company POPELINE & LINON reserves the right to modify its prices at any time. If one or more taxes, change of fiscal or economic data would come to be created or modified, in rise as in fall, this change could be reflected on the selling price of the Products present on the Internet Site.
4 - THE ORDER
The taking of orders on the Site is subject to the respect of the procedure set up by the Companypopeline & linon, which consists of a succession of different steps that the customer must follow to validate his order:
Step 1: the Customer adds the chosen products to his basket. Access to the basket is possible at any time to modify or validate it.
Step 2: the Customer checks the details of his basket, and validates it after choosing his delivery method.
Step 3: the Customer enters his or her full contact details.
Step 4: at the time of validating the order summary, the Customer expressly accepts the general terms and conditions of sale in force on the Site.
Step 5: the Customer chooses his method of payment and is then redirected to the secure payment site where he enters his bank details.
POPELINE & LINON reserves the right to cancel any order from a customer with whom there is a dispute or an incident relating to the payment of a previous order.
POPELINE & LINON will acknowledge receipt of the order by sending an e-mail. To this end, the customer formally accepts the use of e-mail for the confirmation by the Company POPELINE & LINON of the content of his order. In case of unavailability of a product ordered, the customer will be informed by e-mail. The cancellation of the order of this product will then be made.
Invoices are sent by e-mail.
Nevertheless, in certain cases, in particular non-payment, incorrect address or other problem on your account, the company POPELINE & LINON reserves the right to block your order until the problem is resolved.

5 - PAYMENT
The payment of purchases is made by credit card, the Customer accesses a dedicated space provided by a banking institution. For payments by credit card (credit card, visa card, MasterCard), all information that the customer will communicate to the company POPELINE & LINON are strictly protected and guarantee the compliance and security of each transaction.
You can make your payment by using a Paypal account. For this, you must have opened a Paypal account.
You can pay by bank or postal check payable in France by selecting this method of payment when entering your order on the site. To do this, make your check payable to POPELINE & LINON and print the order confirmation email. Enclose it and send it by mail to the following address

Your order will be taken into account upon receipt of your mail and after validation of your means of payment. An email will be sent to you when we receive your mail.
6 - DELIVERY
The company popeline & linonprocesses orders from Monday to Friday (except public holidays). The delivery time is estimated between 4 and 6 working days after receipt of payment. The delivery time is estimated between 4 and 6 working days upon receipt of payment. The times indicated are indicative, corresponding to the average processing and delivery times. The Company popeline & linonshall not be held responsible for the consequences due to a delay in delivery that is not its fault.
Only orders with billing and delivery addresses in metropolitan France are taken into account on the site. Delivery is made to the delivery address indicated by the customer, it being specified that this address must be the customer's home address or any other natural person of his choice domiciled in metropolitan France and Corsica. Delivery cannot be made to hotels or post office boxes.
In case of damaged packages (already opened, missing products ...), the Customer agrees to notify the carrier and the Company POPELINE & LINON, by any means within 3 days of receipt of the product.
Here are the delivery options:
- Colissimo :
For delivery by the Post Office (So Colissimo) at home: postage at 5.90€ and offered from 50€ of purchases, delivery time 48H (2 working days from the shipment of the order). During busy periods, it is possible that the preparation of the order takes 1 or 2 days more.
- In 48 hours in your Relais Colis in Metropolitan France and Corsica: subject to payment of the fixed contribution according to the amount in force (€5.90 as at 01/07/10), for shipping costs and preparation of the parcel.
This service applies to all orders placed before 7pm, for delivery the following day* from midday in one of the 4,000 Relais Colis of your choice (in mainland France and Corsica). The parcel remains available for ten (10) days. After this period, it will be returned to POPELINE & LINON.
Except for orders placed on Fridays, Saturdays and Sundays, which will be delivered on the following Wednesday, from 12:00 noon, and orders placed on public holidays, which will be delivered 72 hours after the order is placed, from 3:00 pm.
For this service: payment with the order only by credit card or card issued by SOFINCO. Your Relais Colis is at your disposal to give you your parcel, and for your returns.
7 - The service satisfied or refunded (right of withdrawal)

All Products delivered are eligible for a refund except those excluded by law, for example Products that have been customised at your request.
The Products must not have been washed or damaged and must be returned intact in their original packaging with any accessories, user manuals and other documentation. Sewing patterns (pouches) must not be opened or used. The pouch must be intact.
You have 15 days from the receipt of the last package of your order to return a Product of your order, according to the provisions below.
POPELINE & LINON will nevertheless accept to take back your Product, as soon as it is returned to us within 15 days from the delivery of the last package of your order. You are responsible for the delivery costs.

The company POPELINE & LINON undertakes to reimburse you, subject to compliance with the conditions mentioned above, the sums as soon as possible and no later than 15 days following receipt of the proof of dispatch of the package to our attention or receipt of the package by us (the first of these two dates being retained).
The accepted proofs of shipment are:
- Receipts, stamped and dated from the Post Office, of deposits of tracked packages :
The refund will be made via the payment method of the returned order.
Thus if the order of Products was paid :
By credit card and the credit card is still valid, your refund of your returns will be made directly by crediting the bank account attached to this card. If the credit card is no longer valid, the refund of your returns will be made directly by check made out to you.
By Paypal, and that the Paypal account is still active, the refund of your returns will be made on this Paypal account.
To help POPELINE & LINON to better serve the Customers, you are asked to indicate the reason for the return.
8 - GUARANTEES
- www.popeline-et-linon.com cannot be held responsible in the event of stock shortage of fabric, late delivery, strikes (including in transport) or force majeure and, more generally, for any event not exclusively and directly attributable to it.
- The photographs illustrating the products on the site www.popeline-et-linon.com are not contractual.
- the Customer accesses, uses and browses the www.popeline-et-linon site at his own risk.
- The company has, popeline & linonfor all stages of access to the site, the ordering process, delivery or subsequent services, only an obligation of means. The company shall popeline & linonnot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion, the presence of computer viruses, etc. Neither the company popeline & linonnor the Customer shall be held liable for any non-performance due to any event qualified as force majeure, beyond its control, including but not limited to, and in accordance with case law, cases of war, riot, insurrection, interruption of transport, import or export problems, strike, lockout, shortage, fire, earthquake, storm, flood, etc.
If, despite our precautions, one of your items arrives damaged or if a product is missing during delivery, simply contact our Customer Relations at 06 30 51 79 06 from Monday to Friday from 9am to 8pm. We will guide you on the procedure to follow.
For all your purchases, you benefit from the legal guarantee of conformity (articles L217-4 and following of the Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the Civil Code), allowing customers to return Products delivered defective or non-compliant.
Guarantee against hidden defects: You may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, you can choose between cancellation of the sale or a reduction of the sale price in accordance with article 1644 of the civil code.
9 - INTELLECTUAL PROPERTY
All elements of the Website are protected by copyright, trademarks or patents. Similarly, the trademarks, logos, designs and models appearing on the Website are the exclusive property of POPELINE & LINON. Their disclosure may not under any circumstances be interpreted as granting a licence or a right to use any of the said trademarks and distinctive elements protected by copyright. They cannot therefore be used under penalty of counterfeiting.
Thus, none of the documents from the Website may be copied, reproduced, republished, downloaded, posted, transmitted or distributed in any way whatsoever.
However, it is possible to download a copy of the documents onto a computer for your personal use and solely for non-commercial purposes, provided that you do not modify the information contained and that you keep intact all copyright and other proprietary notices. Modification of these documents or their use for any other purpose constitutes an infringement of the intellectual property rights of POPELINE & LINON.
10 - SERVICES
However, if you hesitate about a fabric, ribbon, piping, lace, the company popeline & linoncan send you a free sample. Only the delivery costs will be at your charge. As soon as the payment is validated, the company undertakes popeline & linonto deliver the desired sample after having communicated the exact and complete information concerning the delivery address (such as, in particular: street, building, staircase number, access codes, names and/or intercom numbers, etc.).

11 - APPLICABLE LAW - DISPUTES
These general terms and conditions of sale are governed by French law. Any disputes that may arise shall be subject to the exclusive jurisdiction of the French Courts. In the event of difficulty or complaint when placing an order, the customer can contact Customer Service to find an amicable solution.
